When one or both spouses live overseas but the marriage or the assets touch China—especially China real estate—you usually need to separate four questions: jurisdiction and procedure; how China property is identified and divided; how parenting and visitation connect; and whether remote authorization is workable. This is a principles-level overview. Results and timing vary with jurisdiction, the file, and how contested the matter is. Nothing below promises an outcome.
Who this helps
Use this as a first map. How you actually proceed still depends on nationality, residence, and the facts:
- A Sino-foreign marriage, or two Chinese citizens where one has long lived abroad;
- Divorce or separation that still requires dealing with China real estate, deposits, or equity;
- A foreign divorce already done or underway, where you need to see how that judgment meets China-side steps;
- Parenting or visitation where a parent or the child lives across a border.
Common pathways (overview)
Several paths appear in practice. Do not assume one is faster, or that China registration is available, before the file is reviewed:
- Agreement path: spouses settle divorce, property, and children, then complete whatever the competent office requires. Whether China registration is available, or a court process is needed, depends on identity, habitual residence, and the facts.
- Litigation path: if there is no agreement, or the law requires a court, the case proceeds in a court that has jurisdiction.
- Foreign judgment plus China follow-up: if you already divorced abroad but still need to dispose of, register, or enforce against China assets, China-side steps usually have to be mapped separately. Whether a given foreign judgment has effect in China, and in what respect, depends on that judgment and the applicable rules. This page does not assume automatic effect or automatic title transfer.
Property division and parenting/visitation may run on different tracks, with different timing and document focus.
High-level steps
- Confirm marital status, nationality and residence, whether there are children, and the type and city of China assets;
- Assess jurisdiction and options (agreement, litigation, or foreign-judgment follow-up);
- Collect papers for that path; foreign documents often need notarization and an Apostille, or whatever other authentication the issuing place still requires;
- Enter negotiation or filing, and map how China real estate will be identified, disposed of, and registered;

China property division: usual focus points
Whether a unit, deposit, or shareholding falls into the divisible pool depends on the facts and the applicable law. Title in one name, or residence in another country, is not enough by itself. After assets are identified and a division is agreed or adjudicated, transfer, sale, and remittance are later steps, with different papers and reviewers.
Parenting and visitation
Who the child lives with, how visits are arranged, and how support is paid depend on the child’s residence, both parents’ locations, and what the competent office requires. This section only maps common document and path questions. It does not promise a custody or visitation outcome.
Indicative document list
Civil-affairs offices, courts, and registries do not use one nationwide pack. Direction only:
- Identity documents;
- Marriage certificate or other proof of marital status;
- Children’s birth certificates;
- Clues to China assets (title information, account or equity records);
- Any foreign judgment or settlement, plus notarization or authentication as required;
- A power of attorney if you cannot appear (foreign signatures usually need notarization and an Apostille or other authentication).
Remote POA
A common order when you cannot return is: sign a power of attorney where you live; complete local notarization and an Apostille (or other required authentication); send originals to China. A China lawyer may communicate, prepare papers, or appear only within the mandate and what the receiving office allows. Remote verification, if available at all, is case-by-case.

Timing
When spouses agree and papers are relatively complete, some files move more quickly. Asset tracing, cross-border service, jurisdiction disputes, or foreign authentication often run to several months or longer. Those ranges are not promises.
